Subject Access Request

Patients have the right to request access to their medical records, their data and any supplementary information held by Beech House Surgery. A request by a patient, or by a third party who has been authorised to do so by the patient, for access under the GDPR (and DPA 2018) is known as a Subject Access Request (SAR). If you want to receive a copy, please print and complete the online Subject Access Request Form or alternatively, collect a form from Reception. We will contact you to arrange a time for you to come in and collect them. You will be required to produce proof of identity such as a driver’s licence or passport, before being allowed to obtain them.

Please complete the form in full and ensure it is returned with copies of the identity documents as required.

Please also keep any copies you subsequently receive safe as requests for further copies of the same information may be charged for or refused.

Children aged 13 and over are deemed able to provide their own consent under the UK Data Protection Regulations so will need to complete their own requests.

 

Timeframe to respond to a SAR

In accordance with the GDPR, patients are entitled to receive a response within 28 days from the date of submission of the SAR. If additional information is needed before copies can be supplied, the 28-day time limit will begin as soon as the additional information has been received. In the case of complex or multiple requests, the data controller (Beech House Surgery) may need more time to collate and supply the data. In such instances, the data subject must be informed and the reasons for the extension given.

 

Exemptions

There may be occasions when the data controller will withhold information kept in the health record, particularly if the disclosure of such information is likely to cause undue stress or harm to you or any other person. Or when the record has information relating to a third party.
